Kim And Kanye Could Be Going To Court Over Taylor Swift Phonecall

As if 2016 had not seen the world implode enough, most of us awoke this morning to the news that Kim Kardashian had uploaded a video of Kanye speaking to Taytay about the controversial ‘Famous’ video. Stop the world. 

The video was posted online in an attempt to prove that Ms Swift had gave her consent to be featured in the music video for a song which refers to her as ‘that bitch’ – which she has continuously claimed she did not approve of, reports Newsweek.

However – approve or disapprove, Mr and Mrs West may be about to fall face first into a federal law silage pit, as it is against the law in California, where the Kardashian West’s live, to record a phone call without every party member being told.

Swift has already hinted that she wasn’t aware of the call being recorded on her Instagram, writing: ‘That moment when Kanye West secretly records your phone call’.

Oh and in case you’re not worried for the infectious Kimye homestead, then you should be, because Cali are one of the strictest states in the U.S. when it comes to tape-recording consent.

A legal expert told Newsweek that regardless of where Swift took the call she could take the pair of them to civic court, adding:

The aggrieved party could take [their case] to either state. To invoke either state’s law, there’s a conflict of laws analysis that different states go through to determine which laws apply.

A lot of it has to do with where the injury was being felt. If Kanye was in California, we’d need to know what state Taylor was in—if they have two-party consent, she might be more successful bringing the case in the state she was in.

But California tends to be relatively protective of their two-party consent, so she might also be successful in California if the conflict of laws analysis determined that law applied.

If Taylor was successful chances are she’d be entitled to A LOT of damages, and not only normal damages, but also punitive damages too.

However personally, I think the whole thing is a farce anyhow. Taytay, Kimmy, and Kanye, are merely the latest addition to the swarm of elite 21 century icons who fester on publicity – and this is simply their latest false atrocity to grace our screens.

When will this end and when will they all just fuck off back to nothingness? Bring on the lawsuit.
