George Smith, of Markinch, Fife, had reportedly entered into an argument with one of his neighbours while the local man had been working on his car.
The disagreement escalated, with Smith, 26, allegedly spitting on the male victim at least three times before he fell to the ground, as was heard in Kirkcaldy Sheriff Court.
As the victim lay on the ground, Smith ‘attempted to rub his body’ against him. He then proceeded to walk away from the victim, before suddenly pulling down his own trousers to his knees in order to expose himself.

As reported by the Dundee Born and Read Evening Telegraph, fiscal depute Catherine Fraser told Kirkcaldy Sheriff Court how Smith had taken ‘hold of his genitals and started waving them about’.
Police officers were called to the scene, arriving within moments. It was then that Smith headed off in the direction of a local bowling green, with officers giving chase.
Fraser continued:
They got hold of him and he began struggling and attempting to make off, refusing to be handcuffed and challenging officers to fight.
When he was charged with the offences he said he had no recollection of that.
He then added: ‘If you see the size of my knob you would be waving it about’.
Officers noted he was clearly under the influence of alcohol.
GeographSmith has since pleaded guilty on summary complaint to the charges of assault, breach of the peace and resisting arrest committed on December 8, 2018.
Sheriff Grant McCulloch has deferred Smith’s sentence until May 9 in order to allow for social work background reports, stating:
I will defer consideration of whether [sex offender] notification requirements are necessary to determine if this breach of the peace has a significant sexual element or just a drunken element.
