Man Says Gun Went Off Accidentally As Wife Performed Sex Act On Him

A man accused of murdering his estranged wife now claims his gun went off while he performed a sex act on her.

53-year-old John Fitzgerald Gonzalez told officers he was performing a sex act on Nicole Nguyen in their garage, when she reached for his gun.

Las Vegas based Gonzalez claimed this led to a struggle for the weapon, which accidentally discharged, fatally shooting Nguyen in the stomach.

The police reportedly believe this version of events to be implausible, reports the Mirror.

Officers were called to the home at 7:50am by Gonzalez, who met officers outside the home along with the couple’s six-year-old son – Nguyen had a gunshot wound to her left torso.

According to Gonzalez, the weapon fired once. He held the grip of the gun and pulled the trigger as she drew the gun to her.

According to the Las Vegas Review Journal, an officer wrote the following comment in his arrest report:

Detectives found his excuse for having brought the gun and keeping it by him during sex implausible.

The report also stated:

It is unknown if the sex was actually consensual or if it was coerced by force or threats of force.

Gonzalez’s original statement claimed he’d been collecting their son to take him to school when Nguyen brought out a gun. He said this led to a struggle and the gun accidentaly going off.

Nguyen had filed for divorce seven weeks prior to her death, which led to Gonzalez moving out of their home.

However, after his arrest, Gonzalez told police how Nguyen had recently wanted to resume the relationship.

He also said they were both due to – with her attorney, on the day of her death – to put a stop to divorce proceedings.

He says he had a gun with him due to fears he would be ambushed by Nguyen’s ‘guy friends’.

The couple’s young son had been at the home at the time of the shooting, but did not witness the incident and was not injured.
