Making A Murderer’s Brendan Dassey might not be able to catch up on a decade of Wrestlemania just yet.
Last month the 26-year-old had his murder conviction overturned and was due to leave within 90 days, but now the Wisconsin Department of Justice has filed to overturn this decision.
Prosecutors believe that Brendan shouldn’t be released over claims from his defence that there were issues with the investigation.
Attorney General, Brad Schimel, said:
We believe the magistrate judge’s decision that Brendan Dassey’s confession was coerced by investigators, and that no reasonable court could have concluded otherwise, is wrong on the facts and wrong on the law.
Only a month ago a U.S. federal judge overturned the murder conviction of Dassey, who’s case was followed on Netflix’s docu-series Making A Murderer.
Dassey and his uncle Steven Avery were convicted of murdering Teresa Halbach in 2005 and both sentenced to life in prison.
During the documentary, their defence team argued that Brendan was coerced into confessing to a crime he didn’t commit, without a lawyer being present.
But Schimel, believes that these tactics employed by the police were totally fine.
He added:
The investigators did not use constitutionally impermissible tactics. Two state courts carefully examined the evidence and properly concluded that Brendan Dassey’s confession to sexually assaulting and murdering Teresa Halbach with his uncle, Steven Avery, was voluntary.
In response, Brendan Dassey’s family and lawyer released a statement, saying:
We are disappointed in the State’s decision to prolong Brendan’s case by seeking an appeal. We look forward to continuing to defend his rights in court. Like Brendan, we remain grateful to his many supporters for their continued loyalty and strength.
His attorney Kathleen Zellner also had her say on Twitter:
How this will all turn out now is anyone’s guess.
